Our assessment and appeals process

Stage 1: CHC Full Consultation
‣ A full 90-minute consultation with a CHC Lead Practitioner online or in person.
‣ A detailed review of your current CHC decision or CHC checklist (if already completed).
‣ A discussion and summary report of your possible appeal grounds and our preliminary view on your case strengths and areas for further evidence.

Stage 2: Evidence Gathering and CHC Assessment(s)
‣ A comprehensive review of health and care records (via a Subject Access Request).
‣ An expert independent assessment of your needs or retrospective summary review.
‣ Collection of all supporting healthcare and social care documents.
‣ Your own independent CHC checklist (if required).

Stage 3: Appeal Strategy and Case Preparation
‣ Detailed analysis of your Decision Support Tool (DST), or support to attend a DST.
‣ Develop a full appeals strategy with our expert or CHC lead practitioner.
‣ All professional appeal letters and supporting evidence documented.

Stage 4: Advocacy or Representation
‣ Representation as either an advocate or expert in your case. We may suggest linking with a legal professional at this stage, and we always recommend using a regulated and registered solicitor. We work with a small range of CHC expert solicitors and barristers in this area of law and can recommend.

At Nova Care, all our consultants have been social service managers or NHS leaders, so we can address your situation faster and charge you less for our time. While other providers may use newly qualified staff or non-regulated healthcare practitioners, we've been the experts shining a light on NHS Continuing Healthcare since 2017. With Nova Care Consultants, you get the real expertise of practitioners and leaders with the necessary knowledge, skills, and experience in Continuing Healthcare, overseen by an expert director.

Our fees

We can offer a detailed Assessment, Challenge and Appeal Strategy for a fixed fee based on a consultant's hourly rate of £120+ VAT. As a guide, we have broken down the stages with time estimates, but these are estimates only. Each case is individual and may take longer or shorter than the guide below.

A stage 1 service takes us around 8-10 hours.
A stage 2 service takes us around 20-40 hours, or one whole week.
A stage 3 service takes us around 30-40 hours.
A stage 4 service is charged at our standard hourly consultant's rate.

A complete case-managed service from stages 1 to 3 is likely to cost between £8,700 and £13,500, including VAT. If you opt for our Complete Case Managed Service at the start of your journey, we will not charge you a penny more than £11,000 plus VAT, no matter how many additional hours we work on your case.

Don't need our full appeal service? If you require expert advocacy only, our hourly rate for advocacy or representational support starts at £195 per hour for clients who have not used our Stage 1-3 service.

How Long Does The Process Take?

This is a tricky question to answer, as each case can vary from weeks to months. As a guide, Local Appeals take around 3-4 weeks, and an NHS England appeal takes around 6-8 weeks. This is a guide only, as we have supported some cases in under 3 weeks before, and one took over 12 weeks; however, in that case, we secured over a quarter of a million pounds in refunds for the client. Our service is now available to professional Deputies as an Advice, Guidance and Funding Refusal Service, so you can be sure you stay on the right side of Re ACC and Lumb. You therefore agree to instruct us as advisors and to offer expert advice in this regard. We now offer a Desktop Review Service from £695 plus VAT, and we may be able to offer a full NHS CHC or Care Needs Report and Strategy Care Plan for a fixed fee of £1665 plus VAT, which includes travel.

Our service guarantee

We will not charge you more than £11,000 (exc. VAT) for our complete challenge and appeal service. To qualify for this service, you must instruct us at stage 1, and you cannot move to this service once your journey has started. The price promise is a cap, so if we work less than 90 hours on your case, you pay the hourly rate of our work at £125 per hour plus VAT, rather than the price cap; if we work more than 90 hours, we don't charge you a penny more. Terms and conditions apply. Excludes consultations with you as our instructing party, travel fees and independent care needs or health assessments required for your appeal.

In line with our ethical standards, we only accept cases where we believe there is a reasonable prospect of success (typically 60% or higher), as we feel it would be unethical to accept your investment when the likelihood of a favourable outcome is minimal.
